Terms of Service

The operating agreement for Call OS accounts, software, connected services, subscriptions, and outbound workflows.

This document describes Call OS as currently offered. Specific order forms, checkout terms, and signed agreements control if they conflict with this page.

Agreement and eligibility

These Terms of Service govern access to and use of the Call OS website, desktop application, hosted services, updates, support, and Call OS portions of connected Owner IQ workflows. By creating an account, installing Call OS, starting a trial, purchasing a plan, or using the service, you agree to these Terms.

If you use Call OS for an organization, you represent that you have authority to bind it. You must be legally able to enter a contract and use the service for legitimate business purposes.

Accounts and access

You must provide accurate account information, protect your sign-in and connected-service credentials, and promptly report unauthorized access. You are responsible for actions taken through your account and for ensuring each user has an authorized seat or access right.

Access may depend on an authentication provider, active subscription, usage allowance, organization policy, and supported device or calling configuration. We may suspend access that appears compromised, abusive, unpaid, or unlawful.

License and restrictions

Subject to these Terms and payment of applicable fees, Call OS grants you a limited, non-exclusive, non-transferable, revocable right to install and use the service for your organization’s internal business operations during the applicable term.

You may not resell or sublicense the service; circumvent authentication, plan, usage, or export controls; copy or create a competing product from protected elements; scrape or extract Owner IQ data outside authorized workflows; interfere with security or availability; probe other users’ data; upload malware; or use Call OS to violate rights, contracts, platform rules, or law.

Outbound communications

You are the operator and sender of communications made through your configured calling service. You are solely responsible for the origin, accuracy, permission, and suppression status of lead data and for compliance with all telemarketing, privacy, consumer-protection, DNC, caller-ID, recording, transcription, and communications laws.

Features such as DNC handling, calling controls, outcomes, transcripts, and scheduling assist your workflow; they are not legal advice and do not guarantee compliance. You must obtain required consents and disclosures and immediately honor opt-out or suppression requests.

Customer data and AI-assisted features

You retain the rights you have in data you lawfully submit to Call OS. You grant Call OS and its service providers the rights needed to host, process, transmit, synchronize, transform, and display that data solely to provide, secure, support, and improve the service as permitted by the Privacy Policy and your agreement.

AI-assisted research, summaries, responses, classifications, pitch questions, voice features, and recommendations may be incomplete or wrong. They are decision support, not a substitute for verification, professional advice, or the rep’s judgment. Do not rely on them for legal, tax, employment, credit, eligibility, or other high-impact decisions.

You may not submit information you are not authorized to process. You are responsible for reviewing generated content before using it in a call, record, appointment, or customer communication.

Third-party services

Call OS can connect with services such as identity providers, telephony, CRM, payments, maps, transcription, research, cloud infrastructure, and AI providers. Those services are governed by their own terms, availability, pricing, and privacy practices.

We are not responsible for a third party’s outage, policy change, content, data handling, account restriction, or decision to discontinue a feature. You are responsible for maintaining any required third-party account and permissions.

Plans, trials, billing, and cancellation

Plan names, prices, daily allowances, Owner IQ access, concurrency, trial periods, promotions, and taxes are shown at checkout and may change for future purchases. The terms accepted at checkout control your order. Promotional eligibility may be limited and may not renew.

Subscriptions renew as shown at checkout unless canceled. You authorize the payment processor to charge the selected method. Failed payment may suspend access. You may cancel through the available account controls or by contacting support@call-os.com. Unless required by law or stated in writing, fees already paid are non-refundable and access continues through the paid period.

Updates and changes

Call OS may download or offer updates that fix defects, improve security, change compatibility, add features, or modify the service. You are responsible for installing required updates and maintaining a supported Windows environment, browser, calling service, headset, network, and permissions.

We may add, remove, limit, or change features. We will use reasonable efforts to avoid materially reducing paid functionality during a current term without notice, but alpha, beta, preview, experimental, and third-party-dependent features may change at any time.

Ownership and feedback

Call OS, its software, designs, marks, documentation, models, workflows, and other protected materials remain the property of Call OS and its licensors. These Terms do not transfer ownership.

If you provide feedback, suggestions, or ideas, you grant us a perpetual, worldwide, royalty-free right to use them without restriction or compensation, provided we do not publicly identify you as the source without permission.

Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CALL OS IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION.

We do not guarantee call connection rates, appointments, revenue, data accuracy, prospect identity, legal compliance, AI output, carrier behavior, or third-party availability. You assume the risk of using business-contact information and automated or AI-assisted features.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CALL OS AND ITS AFFILIATES, PERSONNEL, AND PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION.

OUR TOTAL LIABILITY ARISING FROM THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR CALL OS IN THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US$100. Some jurisdictions do not allow every exclusion, so these limits apply only to the extent permitted.

Suspension and termination

You may stop using Call OS at any time, subject to subscription terms. We may suspend or terminate access for material breach, unlawful or harmful use, security risk, nonpayment, excessive service burden, or where required by a provider or law.

On termination, your license ends. Provisions concerning payment, ownership, restrictions, disclaimers, liability, disputes, and other terms that by nature should survive will remain effective. Local data may remain on your device until you remove it.

General terms

Before starting formal proceedings, you agree to contact legal@call-os.com and attempt good-faith resolution for at least 30 days. Any signed order form or negotiated agreement may specify governing law, venue, or different dispute terms.

You may not assign these Terms without our consent; we may assign them as part of a restructuring, financing, merger, acquisition, or sale. Failure to enforce a term is not a waiver. If one provision is unenforceable, the rest remain effective. These Terms, the Privacy Policy, checkout terms, and any applicable order form are the entire agreement concerning the service.

We may update these Terms. Material changes will be identified by a new effective date or other reasonable notice. Continued use after changes take effect constitutes acceptance.
