Agreement and eligibility
These Terms of Service govern access to and use of Owner IQ, wherever it is offered, including at owner-iq.com and inside Call OS. By creating an account, starting a trial, purchasing a plan, or using Owner IQ, you agree to these Terms and to the Privacy Policy.
If you use Owner IQ for an organization, you represent that you have authority to bind it. You must be at least 18 years old and use Owner IQ for business purposes.
Accounts
Provide accurate account information, keep your sign-in private, and tell us promptly about unauthorized access. Each login is for one person. You are responsible for activity through your account. We may suspend access that appears compromised, abusive, unpaid, or unlawful.
Plans, trials, billing, and cancellation
Owner IQ access is provided through the plans shown at checkout, including Call OS plans that include Owner IQ. Prices, allowances such as search and export limits, trial periods, and promotions are shown at checkout and may change for future purchases. The terms accepted at checkout control your order.
Subscriptions renew as shown at checkout until canceled, and you authorize our payment processor to charge your selected payment method. Failed payment may suspend access. You can cancel through your account controls or by emailing support@owner-iq.com. Unless the law requires otherwise or we agree in writing, fees already paid are non-refundable, and access continues through the paid period.
Your license to Owner IQ data
While your access is active, we grant you a limited, non-exclusive, non-transferable, revocable license to search and view Owner IQ and to use the records you access or export for your own organization’s internal business-to-business sales and outreach.
Records you exported while your access was active may stay in your own systems after it ends, subject to the restrictions in these Terms and to any request not to be contacted.
Restrictions
You may not:
- resell, sublicense, publish, or give anyone outside your organization access to Owner IQ or its data;
- use Owner IQ data to build, enhance, or verify another database or data product, or to train a model for that purpose;
- scrape, crawl, or extract data by automated means or repeated queries, including through a connected AI assistant, beyond the export tools we provide, or circumvent search, reveal, or export limits;
- share logins or let anyone use your access;
- use Owner IQ data for any purpose covered by the Fair Credit Reporting Act or to decide anyone’s eligibility for credit, insurance, employment, or housing;
- use Owner IQ data to contact people for personal, family, or household purposes, or to harass, stalk, or unlawfully discriminate against anyone; or
- use Owner IQ in violation of law, a contract, or anyone’s rights.
Your outreach and the law
You are responsible for how you use Owner IQ data, including compliance with the Telephone Consumer Protection Act, the Telemarketing Sales Rule, state telemarketing laws, the National Do Not Call Registry and state do-not-call lists, calling-time and caller-ID rules, email laws such as CAN-SPAM, and privacy laws.
Owner IQ does not check numbers against the National Do Not Call Registry. Numbers labeled cell or mobile may be wireless numbers, which carry additional restrictions on autodialed and prerecorded calls and on text messages. You must honor any request not to be contacted, and stop using a person’s information if we tell you it was removed at their request.
Data accuracy
Owner IQ merges information from many sources that change constantly. Records may be incomplete, outdated, duplicated, or wrong, and labels such as owner, cell, verified, or revenue are our best assessment rather than a guarantee. Verify important information before relying on it. We may correct, update, merge, or remove records at any time, including in response to removal requests.
Your data
You keep the rights you have in data you import or create, such as your own CRM records, lists, notes, and verification marks. We process it only to provide and secure the service. It is visible only to your organization, and it is not added to the Owner IQ database or licensed to anyone else without a separate written agreement with you.
Ownership and feedback
Owner IQ, including the database as compiled, its selection, arrangement, and merged records, the software, and the Owner IQ name and marks, belongs to us and our licensors. Apart from the license above, these Terms grant no rights to it.
If you give us feedback or suggestions, you grant us a perpetual, worldwide, royalty-free right to use them without restriction or compensation, provided we do not publicly identify you as the source without permission.
Other services
Owner IQ works with services such as sign-in, payment, Call OS, and AI assistants you connect. Those services are governed by their own terms and privacy practices, and we are not responsible for their availability, content, or decisions.
Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OWNER IQ IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION.
We do not guarantee that any record is accurate or complete, that any number reaches the person listed, or any outreach result, and Owner IQ is not legal advice. You assume the risk of using business-contact information.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OWNER IQ AND ITS AFFILIATES, PERSONNEL, AND PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION.
OUR TOTAL LIABILITY ARISING FROM OWNER IQ WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR OWNER IQ ACCESS IN THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US$100. Some jurisdictions do not allow every exclusion, so these limits apply only to the extent permitted.
Indemnity
You will defend and indemnify us, our affiliates, and our personnel against third-party claims, fines, and costs arising from your outreach, your use of Owner IQ data, or your violation of these Terms or the law.
Suspension and termination
You may stop using Owner IQ at any time, subject to your plan’s terms. We may suspend or end access for a material breach, scraping or other misuse, a security risk, nonpayment, or where the law or a provider requires it.
Provisions about payment, restrictions, ownership, disclaimers, liability, indemnity, and disputes, and others that by nature should survive, remain in effect after access ends.
General terms
Before starting formal proceedings, you agree to contact support@owner-iq.com and attempt good-faith resolution for at least 30 days. Unless a signed agreement says otherwise, these Terms are governed by the laws of the State of Illinois, USA, without regard to its conflict-of-laws principles, and disputes will be resolved in the state or federal courts located in Cook County, Illinois.
You may not assign these Terms without our consent; we may assign them as part of a restructuring, financing, merger, acquisition, or sale. Failure to enforce a term is not a waiver. If one provision is unenforceable, the rest remain effective. These Terms, the Privacy Policy, checkout terms, and any signed order form are the entire agreement concerning Owner IQ.
We may update these Terms. Material changes will be identified by a new effective date or other reasonable notice, and continued use after they take effect is acceptance.
